Introduction

DHRC Nepal is established in 2000 AD by a group of young people from different corners realizing the real situation of PWDs in Nepal. They themselves are having some kinds of disability due to which they suffered in the context of obtaining education, employment opportunities. Since its beginning, DHRC has been persistently doing hard work to create an equal opportunity to all People With Disabilities(PWDs) on the basis of all citizens without disability. DHRC-Nepal has accomplished various activities to make PWDs aware on human rights and the government to realize their responsibility to provide PWDs with their rights. So, DHRC-Nepal has became a catalyst between PWDs and the government for providing legally allocated rights including political rights to PWDs and passing the voice of grassroots to the government through advocacy and law.

Now, it can be proudly said that the devotion of DHRC-Nepal as a NGO, in the field of disability has made a notable achievement. The Supreme Court Verdicts on Free Education, 2060 and Sustenance Allowance with Attendant Charge to the severely and intellectually disabled people, 2069 are the examples of the major achievements which can be taken as a milestone for promotion of Public Interest Litigation (PIL) in disability rights sector. Similarly, another major achievement was the completion of the Disability Rights and Mainstreaming Project, funded by the European Union (Initiative) for Democracy and Human Rights, which ensured inclusive political participation of people with disabilities in 2008.

Disability and Social Inclusion

DHRC-Nepal has always worked to advocate for the protection and promotion of PWDs’ human rights through media advocacy, policy advocacy, project interventions, OPD (organization of people with disability) capacity development, legal advocacy, and public interest litigation. During the initial phase of the organization’s development, DHRC-Nepal received technical support from the Office of the UN High Commissioner for Human Rights (OHCHR) to build capacity. The ethos of the organization has always been about the empowerment of PWDs through knowledge of human rights and self-advocacy. Our efforts to advocate for social inclusion through the judicial system include DHRC-Nepal’s Public Interest Litigation (PIL) in the Supreme Court on Sustenance Allowance with Attendant Charge for severely and intellectually disabled people (2069) and free education for PWDs (2060). Moreover, DHRC offers free legal aid support to the persons with disabilities who are facing the basic human rights violation.

With joint funding from the Embassy of Finland and UNDP, a street theater model was implemented in more than 46 districts to collect feedback from PWDs for incorporation in the draft 2015 Constitution. Landmark achievements were that the term PWD was included in the Constitution, and the success of representations for PWDs to be able to stand as candidates for the House of Representatives and National Assembly. DHRC-Nepal led a 5-year DFID-funded ‘Disabled People’s Advocacy for Change’ program to enshrine disability rights in Nepal’s first constitution, promoting education and participation through a dedicated disabled street theater troupe, Disability Voice magazine, radio and TV programs. DHRC-Nepal had a significant role in formulating and implementing the 2017 Act Relating to PWDs, the first of its kind in Nepal, through advocacy, lobbying and conducting pressure meetings with the relevant government bodies. Since then, DHRC-Nepal has been making similar efforts for the enforcement of National Policy for the Plan of Action on Disability (NPPAD).
